U.S. soldier charged with 17 murders in Afghan killings

KABUL (Reuters) - A U.S. Army sergeant was formally charged with 17 counts of murder on Friday for killing eight adults and nine children in a pre-dawn shooting rampage in southern Afghanistan that further eroded U.S.-Afghan relations already frayed by a decade of war.

Staff Sergeant Robert Bales, a decorated 38-year-old veteran of four combat tours in Iraq and Afghanistan, also was charged with six counts each of assault and attempted murder for attacking two other adults and four children in the March 11 shooting spree, a U.S. armed forces statement said.

Premeditated murder is a capital offence under the U.S. military justice code, so Bales could face the death penalty if convicted. He would face a mandatory minimum sentence, if convicted, of life imprisonment with eligibility for parole, the military statement said.

Bales is accused of walking off his base under cover of darkness and opening fire at civilians in their homes in at least two different villages in Panjwai district in Kandahar province. Defense officials said four men, four women and nine children were killed. A man, a woman and four children were wounded or shot at.

"The charges allege that, on or about March 11, 2012, Staff Sergeant Bales did, with premeditation, murder seventeen Afghan civilians and assaulted and attempted to murder six other civilians," a U.S. armed forces statement said.

Initial reports from Afghanistan put the death toll at 16 people, including three women and nine children. It was not immediately clear where the extra count came from. Afghan officials were still counting 16 on Friday, and U.S. officials said none of the wounded had died.

A U.S. defenses official said the NATO-led International Security Assistance Force in Afghanistan had never confirmed an official death toll and that evidence developed during the investigation led to the decision to bring 17 murder counts.

The killings seriously strained relations between Kabul and Washington, with Afghan President Hamid Karzai demanding that NATO forces leave Afghan villages and withdraw to major bases.

Karzai also demanded that foreign combat troops, most of whom are due to leave the country by the end of 2014, stop carrying out controversial night raids of Afghan homes, seen by NATO commanders as one of the most effective anti-insurgent tactics.

Taliban insurgents vowed to take revenge on NATO forces for the 17 killings, saying they had no faith in any court proceeding.

Bales is being held at Leavenworth military prison in Kansas but is assigned to the 2nd Battalion, 3rd Infantry Regiment headquartered at Joint Base Lewis-McChord in Washington state. That is where the next step in the judicial process is expected to take place.

Under U.S. military law, a Special Court-Martial Convening Authority at Lewis-McChord will decide whether to order an investigation of the charges at an Article 32 hearing, which is similar to a preliminary hearing in a civilian court.

An Article 32 investigation usually gives the accused a fairly detailed overview of the case against him, including testimony and evidence that will be presented, officials say.

Bales' attorney, John Henry Browne, suggested he might use the soldier's mental state as a defense.

"My first reaction to all of this is, prove it ... This is going to be a very difficult case for the government to prove in my opinion. There is no CSI (crime scene investigation) stuff. There's no DNA. There's no fingerprints," Browne told CBS' "This Morning" program before the charges were laid.

But he said: "The mental state eventually will be definitely an issue.

Bales, who had just begun serving his first tour of combat duty in Afghanistan, had suffered a traumatic brain injury during a vehicle rollover on one of his tours in Iraq and also lost part of a foot in a separate incident.

Browne has said Bales was told he wouldn't be sent back into combat after three tours in Iraq, but in December he was called up for a fourth tour in 10 years, this time to Afghanistan.

Lance Rosen, an attorney for Bales' wife, Kari, told ABC News that the staff sergeant called his wife immediately after the incident in Afghanistan and told her "something terrible" had happened.

Rosen said the couple spoke for about three minutes, evidently after Bales had surrendered to coalition forces, before the call was cut off.

Will Annan be able to broker a deal with Syria?

BEIRUT (Reuters) - U.N.-Arab League envoy Kofi Annan meets President Bashar al-Assad on Saturday to press for a political solution to Syria's year-long uprising and bloody crackdown in which thousands of people have been killed.

Annan's talks in Damascus come a day after activists said Assad's forces killed at least 68 people as they sought to extend control over the rebellious city of Homs and crush armed opposition in the northern province of Idlib.

Arab foreign ministers were also due to hold talks in Cairo with Russian Foreign Minister Sergei Lavrov. Russia and China vetoed a U.N. draft resolution last month which would have backed an Arab League plan calling for Assad to step aside.

Activists said tank rounds and mortar bombs crashed into opposition districts in the rebellious central city of Homs, killing 20 people, while 24 were killed in the northern province of Idlib and more deaths were reported elsewhere.

"Thirty tanks entered my neighbourhood at seven this morning and they are using their cannons to fire on houses," said Karam Abu Rabea, a resident in Homs's Karm al-Zeitoun neighbourhood.

One focus of demonstrations was the anniversary of Kurdish unrest in Syria in 2004 when about 30 people were killed.

Many thousands of Kurds demonstrated in northeastern cities, YouTube footage showed, some carrying banners that read "Save the Syrian people". Other clips showed hundreds of protesters in the Assali district of Damascus, burning posters of Assad's father Hafez al-Assad and chanting "God damn your soul, Hafez".

Street protests have swelled every Friday after Muslim prayers since the anti-Assad revolt erupted a year ago, despite violent repression by the military and loyalist militias.

Decisive victory has eluded both sides in an increasingly bloody struggle that appears to be sliding into civil war.

"IMMEDIATE CEASEFIRE"

The former U.N. chief Annan, now the U.N.-Arab League envoy, discussed his mission with current U.N. Secretary General Ban Ki-moon and the head of the Arab League, Nabil Elaraby.

"I have very strongly urged Kofi Annan to ensure that there must be an immediate ceasefire," Ban told reporters in New York after the conference call. After a ceasefire, he said, there should be "inclusive political solutions" found through dialogue.

Annan also plans to meet the Syrian opposition before leaving the country on Sunday. He has called for a political solution, but dissidents say there is no room for dialogue amid Assad's crackdown.

"If (Annan) can persuade Russia to back a transitional plan, the regime would be confronted with the choice of either agreeing to negotiate in good faith or facing near-total isolation through loss of a key ally," the Brussels-based International Crisis Group said in a paper this week.

Along with China, Russia has opposed any U.N. resolution, fearing Libya-style military intervention, a position Germany hoped might change after Vladimir Putin's victory in the presidential election on Sunday.

"I hope that Russia has a clearer view after the election. It is crucial that the U.N. Security Council gives a clear statement that shows that we stand by the people of Syria and are against violence and repression," German Foreign Minister Guido Westerwelle told reporters at an EU meeting in Denmark.

Russia, an old ally of Damascus and its main arms supplier, has defended Assad against his Western and Arab critics, twice joining China in vetoing U.N. resolutions on Syria.

A Russian diplomat said Assad was battling al Qaeda-backed "terrorists" including at least 15,000 foreign fighters who would seize cities if government troops withdrew.

The Syrian opposition denies any al Qaeda role in the uprising, but Assad's opponents have taken up arms. The British-based Syrian Observatory for Human Rights said five soldiers were killed when their armoured personnel carrier was attacked by army deserters in the southern province of Deraa.

NO EQUIVALENCE

France's Foreign Ministry said Paris would not accept any U.N. Security Council resolution which would assign responsibility for the violence in Syria equally between the Syrian government and the opposition.

"There is no equivalence between the savage repression that Bashar al-Assad's clan has perpetuated for months and the legitimate desire of the Syrian people for the respect of their rights," said ministry spokesman Bernard Valero.

Foreign Minister Alain Juppe denied Russian suggestions the West was seeking a pretext for military action: "The option of any military intervention is not on the table," he said.

China, which despatched an envoy to Syria this week, said on Friday it would send an assistant foreign minister to the Middle East and to France to discuss a way forward.

Beijing urged Annan to "push for all sides in Syria to end their violence and start the process of peace talks".

U.N. humanitarian chief Valerie Amos, who visited Homs this week, said Assad's government had agreed to join U.N. agencies in a "limited assessment" of civilian needs in Syria, but had not met her request for unhindered access for aid groups.

Syrian officials had asked for more time, she told a news conference in Ankara after visiting Syrian refugees arriving in growing numbers in border camps in Turkey.

Amos said she was "devastated" at the destruction she saw in Homs and that she wanted to know the fate of civilians who had lived in the city's Baba Amr district, which rebel fighters left on March 1 after a 26-day siege.

Syrian security forces have killed well over 7,500 people since the anti-Assad uprising began a year ago, according to a U.N. estimate. The government said in December that "armed terrorists" had killed more than 2,000 soldiers and police.

U.S. soldier could get death penalty for Afghan shootings

The US soldier accused of killing 16 Afghans could be executed if convicted, the Pentagon chief said, as President Barack Obama warned a war-weary public against a rushed exit from Afghanistan.

Defense Secretary Leon Panetta told reporters aboard his plane en route to Kyrgyzstan that the shooting suspect would be brought to justice under the US military legal code, which allows for the death penalty in some cases.

The US army sergeant, who was on his first tour of duty in Afghanistan after serving three tours in Iraq, left his base in Kandahar province before dawn Sunday and went on a murderous rampage, Afghan and US officials say.

He is accused of breaking into village homes and opening fire, killing 16 people including women and children, in an incident that has imperilled Afghan-US relations anew after the burning of Korans at a US military base.

"Then at some point after that (he) came back to the forward operating base and basically turned himself in," Panetta said late Monday. "Told individuals what happened."

The Pentagon chief was asked if the suspect could be sentenced to death. "My understanding is in these instances that could be a consideration," he said.

Afghan President Hamid Karzai has described the shootings as "unforgivable," and the Afghan parliament declared that "people are running out of patience" over the behavior of the 130,000 US-led NATO troops deployed in the country.

The Taliban, leading a 10-year insurgency against the foreign troops and Karzai's government, threatened to take revenge against "sick-minded American savages."

The parliament on Monday demanded that US officials "punish the culprits and try them in a public trial before the people of Afghanistan," then closed for the day in protest.

But the Pentagon made clear that it would prosecute the soldier. He has not been named, but officials said he is in his 30s and that the investigation will look into whether he may have been suffering from mental trauma.

The massacre is the latest serious test of the US-Afghan alliance as the two countries pursue difficult talks on securing a strategic pact to govern their partnership once foreign combat troops leave Afghanistan in 2014.

One major sticking point is the Karzai government's refusal so far to grant legal immunity to US troops -- the same issue that scuppered a US strategic pact with Iraq.

In Washington, Obama warned the US public against "a rush for the exits" from Afghanistan, after a new poll at the weekend said most Americans believe the war in Afghanistan is not worth the cost and want an early pullout.

"It's important for us to make sure that we get out in a responsible way, so that we don't end up having to go back in," Obama said in an interview with CBS station KDKA in Pittsburgh.

"But what we don't want to do, is to do it in a way that is just a rush for the exits," he said, stressing the need for an orderly withdrawal to get US personnel and equipment out.

Obama added: "We have got to make sure that the Afghans can protect their borders to prevent Al-Qaeda coming back."

But in a separate interview with Denver CBS affiliate KCNC, Obama said it was "important for us just to make sure that we are not ... in Afghanistan longer than we need to be."

The commander of US-led forces in Afghanistan, US General John Allen, told CNN the killings appeared to have been an "isolated act."

An Afghan soldier detected the absence of the US sergeant and immediately reported it, Allen said.

"We put together a search party right away and it was as that search party was forming that we began to have indications of the outcome of his departure."

The weekend incident is the latest in a series of actions by troops that has provoked outrage in Afghanistan, and comes weeks after the burning of the Korans sparked riots that killed 40 people and plunged ties to an all-time low.

Braced for the worst, the US embassy urged its citizens in Afghanistan to take extra precautions.

But there were no reports of protests by late Monday, and Kandahar community leaders appealed against any violence.

Karzai spoke by telephone with relatives of those killed, including Rafihullah, a 15-year-old boy wounded in the leg who told the president the soldier had torn the dresses of the women in the house and insulted them.

"He came to my uncle's home, he was running after women, he was tearing their dresses, insulting them," Rafihullah said on an audiotape of the conversation heard by AFP.

"He killed my uncle and killed our servant and killed my grandma, he shot dead my uncle's son, his daughter," the boy said.

Space junk threatens station astronauts

WASHINGTON (AP) — A discarded chunk of a Russian rocket is forcing six space station astronauts to seek shelter in escape capsules early Saturday.

NASA spokesman Rob Navias (NAVE-e-us) says the space junk will barely be close enough to be a threat. But if it hits the station it could be dangerous, so the astronauts — two Americans, three Russians and a Dutchman — will wake early and climb into two Soyuz vehicles ready to rocket back to Earth just in case.

The debris is supposed to come closest at 2:38 a.m. EDT. It was not noticed until Friday, too late to move the International Space Station out of the way.

This is the third time in 12 years that astronauts have had to seek shelter from space junk.

This works out as a great deal considering a standard HTC One X costs around $780 and Beats sell their Solo headphones for $180.

Pre-orders for the Deluxe Limited Edition start on March 20, so you still have some time to break the piggy bank and check your pockets for some change.

3 Polish climbers missing on frigid Pakistan mountain

ISLAMABAD (AP) — Feelings of triumph over the first winter ascent of Gasherbrum-1 by a Polish team were marred by growing concern Tuesday over the fate of three other climbers last seen high on the Pakistani mountain five days ago, battling temperatures of 70 below zero and ferocious winds.

The three — an Austrian, a Swiss and a Pakistani — were just short of the summit in the Karakoram range when they were spotted Friday by a Polish team that was descending after it had reached the top of the 8,611 meter (28,251 feet)-high peak.

Pakistan Alpine Club president Manzoor Hussain said he hoped weather might allow a helicopter to circle the peak later Tuesday to try and locate the missing men. Cloud and high winds had prevented any aircraft getting near the mountain since Friday.

Hussain said he feared the men were dead.

"Frankly, there is no possibility of them surviving a night or two up there," he said. "I feel we have lost them."

Mohammad Ali, the manager of the tour agency that helped organize the trip, said he hoped the men had managed to descend to a lower camp on the mountain and were still alive.

"They are very experienced," he said. "We very much hope they are OK."

All the climbers on the mountain, also known as Hidden Peak, were part of the same expedition, but were attempting different routes. The two Poles summitted early on Friday after besieging the peak along with several other climbers for more than two months.

Winter ascents of the world's 14 highest mountains are some of most prized achievements left in climbing.

The "eight-thousanders," as they're known since they all top 8,000 meters (5 miles), were all conquered in summertime long ago. Winter climbing is far more dangerous and difficult.

The success last week on Gasherbrum-1 means only three "eight-thousanders" have yet to see a winter ascent.

Hussain said there was no question of celebrating the first ascent when the fate of the other three climbers remained unknown. "This is terrible," he said.

A Russian team abandoned an attempt on K2, the world's second highest peak, last month after one of the climbers died.

Last year, three mountaineers climbed Gasherbrum II, the first winter success in the Karakorams, which is home to four of the "eight-thousanders." The range is further north than the Himalayas, where Everest is located, and thus sees harsher winters.

The leaked specs of the LG Lucid 4G mark the second LTE-enabled LG phone rumor for the day. The Lucid 4G (also known as Cayman) is a Gingerbread droid of the mid-range variety that is heading to Verizon.

It has a 4" NOVA IPS-LCD display with 480x800 and Gorilla glass protection. There's a 1.2GHz dual-core processor powering the LG Lucid 4G (the chipset isn't clear yet). There's also 8GB of built-in memory.

The connectivity side is well covered - LTE is present (obviously) and you can share that data connection with up to 10 other devices, EVDO Rev. A as fallback, then there's Wi-Fi b/g/n with Wi-Fi Direct support, Bluetooth 3.0 and USB 2.0.

The LG Lucid 4G measures 119.1 x 62.2 x 11.4 mm and weighs 142 g. Its 1700mAh battery is good for up to 350 hours of standby and up to 8 hours of usage.

The Lucid 4G might launch next Thursday (March 29) in the sub $200 price range, but as usual with rumors this isn't set in stone.
